DAMAGE PREVENTION AND FREIGHT CLAIMS
Freight damage can almost always be avoided by proper loading. All intermodal shipments with CSXT Intermodal must be loaded in compliance with guidelines published in the Intermodal Loading Guide for Products in Closed Trailers and Containers. This document incorporates AAR Circular 43-C, BOE Pamphlet 6C and AAR Pamphlet 45. It can be obtained from the Association of American Railroads.
If hazardous materials are involved, loading must comply with both the AAR's Intermodal Loading Guide and the DOT Hazardous Materials Regulations. For more information, contact the hazardous materials department.
Intermodal has a team dedicated to assuring Safe Load Configuration on every load you ship, whether you are a new customer or you are moving new freight.
Despite proper loading procedures, shipments occasionally are damaged. If you detect evidence of damage or shortage to your shipment, you must notify the destination rail carrier within 24 hours so that an inspection by the destination carrier can be arranged. Inspections must be made or waived before unloading the lading. If you are unsure how to contact your destination rail carrier, please call CSXT Freight Loss and Damage Claims at 800-531-1334 to report your damage/shortage and obtain further instruction.
CSX freight loss and damage coverage will not exceed the amount of actual loss or damage sustained by the cargo plus any cost incurred to preserve the cargo or limit any additional damage. In no event will CSXT Intermodal be liable for special, indirect, punitive or consequential damages. CSXT Intermodal's liability for loss or damage to lading of a single vehicle shall not exceed $250,000 or the destination value of the lading, whichever is less. Claims for loss or damage to freight must be filed with CSXT, in writing or through available electronic data interchange (EDI), within 9 months from the date of delivery. (Refer to eBusiness Tools for more information on EDI.)
The information that you need to provide includes:
· Information to identify the shipment, such as the shipping date, the shipping vehicle number, the names of the shipper and receiver as well as the place of origin and destination.
· A description of the commodity.
· In the case of a shortage, certification of the quantity of goods tendered and both original and destination seal records.
· In the case of damage, records pertaining to the condition of the product at origin and at destination.
· Evidence of the amount of the loss, such as original or certified copies of any invoices and repaid bills, as well as evidence relating to the disposition of salvage.
· A copy of any freight bill received or paid in connection with the shipment. CSXT processes claims relating to all Intermodal shipments, regardless of the number of carriers involved in the move.
